The Dual-Regulated Advantage: Lessons from the FCA and Danish FSA

Operating as a dual-regulated EMI under the UK FCA and Danish FSA, and reconciling principles-based and rule-based supervision into an operational moat.

Running an electronic money institution under one regulator is demanding. Running one under two, the UK FCA and the Danish FSA, means meeting two supervisory philosophies at once.

Principles versus rules

The FCA's approach is largely principles-based: outcomes matter, and firms must show their judgement. The Danish FSA tends to be more rule-based and prescriptive. Each asks for different evidence of the same underlying control.

One control framework, two lenses

The answer is not two compliance programmes. It is one framework strong enough to satisfy both: documented reasoning for the principles-based view and precise, auditable rules for the prescriptive one.

Why it becomes a moat

A framework that withstands both regimes is hard to replicate. It earns the trust of partner banks, shortens due diligence and gives access to UK and EU markets with confidence.
